Terms and Conditions

1. Acceptance of these Terms
These Terms and Conditions ("Terms") form a binding agreement between you ("you", "the User") and Dataverify ("we", "us", "our"), operator of dataverify.com.ng. By ticking the acceptance box on our registration page, creating an account, funding a wallet, or using any part of our platform, you confirm that you have read, understood and agreed to be bound by these Terms.
If you do not agree with any part of these Terms, please do not register for or use the platform.
2. Definitions
- Platform - the dataverify.com.ng website, dashboard, developer API and any related service we operate.
- Services - identity verification and slip generation (including NIN, BVN and related searches), identity modification and correction requests, validation, personalisation, IPE clearance, attestation, CAC registration support, bill and utility payments, and any other service listed on your dashboard.
- Wallet - the prepaid balance held in your account and used to pay for Services.
- Data Subject - the individual whose personal record is the subject of a search, verification or modification request.
- Provider - any third party, government agency or upstream partner from which record data or a service is sourced.
3. Eligibility and Registration
- You must be at least 18 years old and legally capable of entering a binding contract.
- You must provide accurate, current and complete information at registration, including your full name, valid phone number and valid email address, and keep it up to date.
- One person or business may hold one account unless we approve otherwise in writing. Accounts created with false, duplicated or stolen details may be closed without notice.
- We may require additional verification of your identity or business before enabling certain Services, and we may decline or discontinue any registration at our discretion.
4. Account Security
- You are solely responsible for keeping your password, transaction PIN, API key and one-time codes confidential. Never share them with anyone, including anyone claiming to be our staff.
- Every action performed with your credentials is treated as performed by you, and every charge arising from it is payable by you.
- Notify us immediately at support@dataverify.com.ng if you suspect unauthorised access. We may freeze an account or reverse pending actions where we reasonably suspect compromise or fraud.
- We may log your device and connection details for security and fraud-prevention purposes.
5. Wallet, Funding and Payments
- Services are prepaid. You must maintain a sufficient Wallet balance before a request is placed.
- Funding is accepted through the payment channels shown on your dashboard. Funds are credited once our payment partner confirms settlement; delays caused by a bank or payment processor are outside our control.
- Always fund using the account or reference shown on your dashboard. Transfers sent to any other account, or without the correct reference, may not be traceable.
- Your Wallet is a prepaid service balance, not a bank deposit. It earns no interest and must not be used as a savings or transfer account.
- Where a funding is later reversed, charged back or found to be fraudulent, we may debit the corresponding amount from your Wallet and suspend the account pending investigation.
6. Service Charges
- The price of each Service is displayed on the platform before you submit a request and is deducted from your Wallet when the request is processed.
- Prices may change at any time to reflect Provider costs; the price shown at the time of your request applies to that request.
- A search that is completed successfully is billable even where the result is "no record found", because the Provider charges us for the lookup. Please confirm the details you enter before submitting.
- You are responsible for the accuracy of every detail you submit. Charges arising from a wrong NIN, BVN, tracking ID, phone number or date of birth supplied by you are not refundable.
7. Refunds and Reversals
- Where a request fails for a reason on our side or on the Provider's side and no result is delivered, the amount charged is returned to your Wallet, automatically or after review.
- Refunds are made to your Wallet balance. Withdrawal of a Wallet balance to a bank account is at our discretion and may be declined where fraud, chargebacks or a breach of these Terms is suspected.
- Completed Services, delivered slips and results submitted to a Provider are not refundable.
- If you believe you were wrongly charged, contact support within 7 days of the transaction with the transaction reference. Claims made after 90 days may not be entertained.
8. Lawful Use and Consent
Important: You may only search, verify or modify a record where you are the Data Subject, or where you have the informed consent of the Data Subject or another lawful basis to do so.
- You must comply with the Nigeria Data Protection Act 2023 and every other applicable law in your use of the platform.
- You must not retain, publish, resell or share personal data obtained through the platform beyond what the Data Subject consented to.
- You must keep records of consent and produce them on request from us, a Provider or a regulator.
- You accept full responsibility and liability for any search or modification carried out under your account without a lawful basis.
9. Prohibited Conduct
You must not:
- Use the platform for identity theft, impersonation, stalking, harassment, fraud, or to enable any criminal act.
- Submit forged, altered or fabricated documents, screenshots or payment proofs.
- Share, sell, sublicense or publish your API key, or allow another party to access the platform through your account without our approval.
- Scrape, bulk-harvest, mirror or build a competing database from results obtained through the platform.
- Attempt to bypass pricing, security controls, rate limits or authentication, probe or attack our infrastructure, or introduce malicious code.
- Use the platform in any way that exposes us or a Provider to legal or regulatory liability.
Breach of this section may lead to immediate closure of your account, forfeiture of a disputed balance, and referral to law enforcement or the relevant agency.
10. Third-Party Providers and Availability
- Record data is supplied by government agencies and third-party partners. We transmit and format that data; we do not create it and cannot alter or guarantee its accuracy or completeness.
- Services depend on Provider uptime. Outages, maintenance, network faults and Provider policy changes may delay or interrupt a Service, and we do not guarantee uninterrupted availability.
- A Provider may decline, reverse or reject a request. Where that happens, our obligation is limited to refunding your Wallet in line with section 7.
11. Manual Services and Turnaround
- Some Services - including modifications, validation, personalisation, IPE clearance, attestation and CAC registration - are processed manually or by a Provider's back office, and are not instant.
- Any timeline we quote is an estimate, not a guarantee. Timelines depend entirely on the responsible agency or Provider.
- A request may be rejected by the agency for reasons outside our control, such as mismatched details, an unresolved record or an unsupported change. Where the agency does not process the request, we refund in line with section 7.
- You must supply clear, genuine and complete supporting documents. Incomplete or unreadable submissions will be returned and may delay processing.
12. Developer API
- Your API key is personal to your account. You are responsible for every call made with it and every charge those calls generate.
- We may apply rate limits, and may throttle or suspend a key that generates abusive, looping or excessive traffic.
- Endpoints, response formats and prices may change. We will give reasonable notice of breaking changes where practicable, but you should build defensively.
- You must keep your integration secure and must not expose your API key in client-side code, public repositories or shared documents.
13. Resellers
- Where you onboard users under a reseller arrangement, you remain responsible for their conduct and for compliance with these Terms.
- You must not present yourself as an agent, employee or partner of a government agency, or of a Provider, or make claims about a Service that we have not published.
- Commissions and reseller pricing are set on the platform and may be reviewed at any time.
14. Data Protection and Privacy
- We collect and process your account details, transaction records, device and connection information, and the search parameters you submit, in order to deliver and secure the Services.
- We share only what is necessary with Providers and payment partners to fulfil your requests, and with regulators or law enforcement where the law requires it.
- We retain transaction and audit records for as long as the law and our legitimate business interests require, including after account closure.
- You may request access to or correction of your account data by writing to support@dataverify.com.ng. Some data cannot be deleted where retention is required by law.
- Where you use the platform to process another person's data, you are the controller of that processing and are responsible for the lawful basis behind it.
15. Intellectual Property
The platform, its name, logo, software, layout, documentation and generated templates belong to Dataverify and are protected by law. You are granted a limited, non-exclusive, non-transferable right to use the platform for its intended purpose. You may not copy, clone, decompile or repurpose any part of the platform without our written permission.
16. Suspension and Termination
- You may stop using the platform at any time and may ask us to close your account.
- We may suspend or close an account, with or without prior notice, where we reasonably believe there is fraud, a breach of these Terms, a legal or regulatory requirement, or a risk to other users, to us or to a Provider.
- On closure, any undisputed Wallet balance may be withdrawn subject to our verification checks. Balances traced to fraud, chargebacks or unlawful activity may be withheld pending investigation.
17. Limitation of Liability
- The platform is provided on an "as is" and "as available" basis, without warranty of any kind beyond what the law requires.
- We are not liable for the accuracy of records supplied by a Provider, for a Provider's decision, delay or outage, or for any loss arising from details you entered incorrectly.
- We are not liable for indirect, incidental or consequential loss, including loss of profit, business, goodwill or data.
- Where liability cannot lawfully be excluded, our total liability for any claim is limited to the amount you paid for the specific transaction giving rise to the claim.
18. Indemnity
You agree to indemnify and hold harmless Dataverify, its officers, staff and partners against any claim, loss, fine or expense (including reasonable legal fees) arising from your use of the platform, your breach of these Terms, or your processing of another person's data without a lawful basis.
19. Changes to these Terms
We may update these Terms from time to time. The current version is always published on this page with its version number and update date. Continued use of the platform after an update means you accept the revised Terms. Where a change is material, we will make reasonable effort to notify you by email or through the dashboard.
20. Governing Law and Disputes
These Terms are governed by the laws of the Federal Republic of Nigeria. Please contact our support team first so we can resolve any complaint amicably. Where a dispute cannot be settled within 30 days, it shall be submitted to the competent courts of Nigeria.
